TREE PRESERVATION ORDERS

A Tree Preservation Order (TPO) is the legal order to protect and preserve trees. All species of tree can be protected from a single tree to all trees within a defined area or woodland.

A TPO prevents felling, lopping, uprooting or other work to a tree without permission. If you break the TPO you could face a significant fine. TPOs are administered by your local Council as the Local Planning Authority (LPA) and are made to protect trees that provide a significant amenity benefit to the area.

It is a criminal offence to cut down, top, lop, uproot, wilfully damage or wilfully destroy a tree protected by a TPO, or to cause / permit such actions, without the authority’s permission. Such an offence is liable to prosecution, and a unlimited fine can be imposed.  If you wish to undertake work to a tree covered by a TPO, an application will need to be made to the local authority. All proposed works need to a justified agriculturally with supporting evidence such as VTA results or photos from an aerial inspection for example.
